1. Agreement to Terms

By accessing or using BMWCodex (the "Service"), available at bmwcodex.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and BMWCodex ("we," "us," or "our").

2. Service Description

BMWCodex, operated by CodeOmnific (codeomnific.com), is a subscription-based online knowledge base that provides BMW vehicle coding information, including but not limited to coding guides, step-by-step procedures, fault code references, module documentation, diagnostic information, and search tools. The Service is intended as an educational and informational resource for BMW enthusiasts and professionals.

3. Account Registration and Eligibility

To access the Service, you must create an account by providing a valid email address and password. By registering, you represent and warrant that:

• You are at least 16 years of age.
• The information you provide during registration is accurate and complete.
• You will maintain the security of your account credentials.
• You will promptly update your account information if it changes.
• You are responsible for all activity that occurs under your account.

You must not share your account credentials with any third party. Each account is for a single individual user only.

4. Subscription and Billing

Access to the full content of BMWCodex requires a paid subscription. By subscribing, you agree to the following:

• Recurring billing: Subscriptions are billed on a monthly recurring basis. Your payment method will be automatically charged at the beginning of each billing cycle.
• Payment processing: All payments are securely processed through Stripe. We do not store your full credit card details on our servers.
• Cancellation: You may cancel your subscription at any time through your account billing settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. No partial refunds are issued for unused portions of a billing cycle.
• Price changes: We reserve the right to modify subscription pricing. You will be notified of any price changes at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

The Service is provided for your personal and educational use. You agree not to:

• Redistribute, republish, or resell any content from the Service.
• Copy, reproduce, or create derivative works from the Service's content for commercial purposes.
• Share your account access with others or operate shared or group accounts.

7. Disclaimer and Assumption of Risk

BMWCodex provides informational and educational content about BMW vehicle coding. The Service does not provide professional automotive, mechanical, or electrical engineering advice. All content is provided on an "as-is" and "as-available" basis.

Vehicle coding carries inherent risks. Modifying your vehicle's software configuration may void your manufacturer warranty, affect vehicle safety systems, cause malfunctions, or result in damage to your vehicle's electronic control units or other components. You acknowledge and agree that:

• Any coding changes you make to your vehicle are performed entirely at your own risk.
• BMWCodex provides information only and does not perform, supervise, or endorse any coding modifications to your vehicle.
• We do not guarantee the accuracy, completeness, or currency of any content on the Service.
• You are solely responsible for determining whether any coding procedure is appropriate for your specific vehicle.
• We are not responsible for any damage, malfunction, warranty issues, or other consequences arising from your use of the information provided.

8. Limitation of Liability

To the maximum extent permitted by applicable law, BMWCodex and its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, vehicle damage, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service. Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine:

• Violates these Terms or any applicable laws.
• Is harmful to other users, third parties, or the business interests of BMWCodex.
• Involves unauthorized redistribution or scraping of our content.

Upon termination for cause, you will not be entitled to any refund of subscription fees. You may terminate your account at any time by canceling your subscription and contacting us to request account deletion.
